Which regime a foreign licence falls under, and what each one asks

The short answer

It depends on the issuing country. An EU or EEA licence may be driven on until it expires, and residence must be notified to the IMT within 60 days of taking it up. Holders from a named OECD and CPLP list may drive on after residence without exchanging, on six conditions. Other convention holders have 90 days and a fine.

Average time for the Portuguese licence to be issued

The service page gives sixty days as the average time for the Portuguese licence to arrive, except where a practical test is required, and says a provisional guia is issued meanwhile so the holder can keep driving while waiting. It is how long the state takes, not a deadline the applicant has to meet.

Period a non-resident may drive on a foreign licence

Artigo 125.º n.º 3 of the Código da Estrada, counted from entering the country, and it applies only while the holder is not resident here. IMT, I.P.-RAM publishes the same period. segurancarodoviaria.pt still prints this provision in the pre-2022 lettering (alíneas c, d, e), which is why this cites the Diário da República text of Decreto-Lei n.º 46/2022 instead — see the sources list for what that stale consolidation gets wrong.

Deadline to exchange after taking up residence

90 days

Artigo 125.º n.º 4 of the Código da Estrada: "Após fixação da residência em Portugal, o titular das licenças referidas no número anterior deve proceder à troca do título de condução, no prazo de 90 dias." The deadline itself was written by Decreto-Lei n.º 40/2016; Decreto-Lei n.º 46/2022 later moved the lettering it points at. It reaches the licences in n.º 1 alíneas d), e) and g), in the lettering Decreto-Lei n.º 46/2022 left behind: that decree inserted a new alínea c) for the OECD and CPLP regime and pushed the old c), d) and e) down to d), e) and g). It does not reach an EU or EEA licence, which is alínea b), and it does not reach the OECD and CPLP regime, because alínea c) is absent from the list in n.º 3. Consolidations that predate the 2022 decree still show the old lettering, under which the same sentence reads as its own opposite.

Fine for breaching the driving rules

Artigo 125.º n.º 8, for a breach of n.ºs 3 and 5 by the holder of an otherwise valid licence. The scope is not settled between sources: the Diário da República text of n.º 8 reads "quem infringir o disposto nos n.os 3 e 5", while the public consolidations at segurancarodoviaria.pt and pgdlisboa.pt both print "3 a 5". On the Diário da República reading the ninety-day duty in n.º 4 is not among the fined provisions. This page follows the Diário da República and says so, because a consolidation is not the statute. Decreto-Lei n.º 40/2016 wrote n.º 8 in the same article that inserted the ninety-day n.º 4 and moved the old n.º 4 down to n.º 5 — the Diário da República prints "5 — (Anterior n.º 4.)" two lines above it. A clause that had read "3 e 4" becomes "3 e 5" under exactly that renumbering, so the pairing is deliberate rather than a slip.

Deadline to register residence with the IMT

60 days

Counted from taking up residence in Portugal. The wording was set by the 2014 republication of the Regulamento da Habilitação Legal para Conduzir and has not been touched since: Decreto-Lei n.º 40/2016, Decreto-Lei n.º 102-B/2020 and Decreto-Lei n.º 114/2026 each amended neighbouring numbers of the same article and explicitly left this one unchanged ("3 — [...]"). "Os condutores portadores de títulos de condução emitidos por Estado membro da União Europeia ou do espaço económico europeu que fixem residência em Portugal devem, nos 60 dias subsequentes, comunicar esse facto ao serviço desconcentrado do IMT, I. P." The IMT states the registration itself is free. This is a different sixty days from the average time gov.pt gives for a Portuguese licence to arrive.

EU or EEA licence with no printed validity — time to exchange

two years

Applies only to an EU or EEA licence that prints no termo de validade. IMT, I.P.-RAM: "Caso não mencione termo de validade é fixado um prazo de validade administrativa de dois anos, a partir da data em que o titular fixe residência em território nacional, para efetuar a troca." For that cohort the exchange is therefore not open-endedly optional. It is a different two years from the request window published for the convention and bilateral-agreement countries. It is not only an agency table: the RHLC's artigo 13.º n.º 4 fixes this same administrative validity — "é fixado o prazo de validade administrativa de dois anos, a partir da data em que o seu titular fixe residência" — a separate, earlier clock from artigo 14.º n.º 1 b), which opens a further two-year grace window only once artigo 13.º's own deadline has lapsed ("Findo o prazo fixado no n.º 4 do artigo anterior..."). They are two different two-year clocks, not two readings of one. Decreto-Lei n.º 40/2016's preamble states the consequence: a holder of a lifetime licence who does not exchange within the period becomes subject to a driving examination.

Portugal has four regimes for a foreign driving licence, and which one applies is decided by the issuing country rather than by anything the holder does.

They differ in what they ask. One asks nothing but a registration. One attaches six conditions and no deadline. One has a deadline and a fine. One does not permit driving at all.

The four regimes

The six conditions the OECD and CPLP regime attaches

The IMT states them as cumulative — "se observarem os seguintes requisitos", and there are six:

  1. the issuing state has signed one of the traffic conventions (Geneva 1949, Vienna 1968) or holds a bilateral agreement with Portugal;

  3. the holder is under 60, source: IMT — Instituto da Mobilidade e dos Transportes, Decreto-Lei n.º 46/2022 — one of six cumulative requirements, read August 29, 2026;
  4. the foreign licence is valid;
  5. the driver meets the Portuguese minimum age for the categories the licence carries;
  6. the licence is not seized, suspended, expired or revoked, in Portugal or in the issuing state.

The first condition is why several of these countries also appear in the convention list further down the IMT’s own table — it is a requirement of this regime rather than a competing one. It does not hold for all of them: Angola, Moçambique and São Tomé e Príncipe qualify through a bilateral agreement rather than a convention.

Where the deadline and the fine reach

Number 4, which carries the deadline, applies to "as licenças referidas no número anterior", and number 3 names alíneas d), e) and g) of number 1 — the lettering left by Decreto-Lei n.º 46/2022, which inserted a new alínea c) for the OECD and CPLP regime and moved the others down. An EU or EEA licence is alínea b), and the OECD and CPLP regime is the new alínea c), which number 3 does not name. The fine at number 8 is written, in the Diário da República text, against numbers 3 and 5 — the public consolidations print "3 to 5", and on the Diário da República reading the ninety-day duty at number 4 is not among the fined provisions, and number 5 refers to the titles in number 1 generally, so it is not exclusive to one regime — but the ninety-day deadline is.

The RHLC's own exchange procedure does not fully match this. Artigo 14.º n.º 1 of the Regulamento da Habilitação Legal para Conduzir offers an exchange without a driving exam only for a licence under alínea a) or b) (EU/EEA) or under alínea c) or d) of artigo 125.º (OECD/CPLP and the traffic conventions), each on a two-year window measured from taking up residence — not the 90 days, source: Diário da República, Artigo 125.º n.º 4 — after residence is established, read August 29, 2026 the Código sets. It names no route at all for alínea e) (reciprocity) or alínea g) (an international driving permit), even though the Código's own duty to exchange within 90 days, source: Diário da República, Artigo 125.º n.º 4 — after residence is established, read August 29, 2026 reaches both.

The United States, the United Kingdom and Switzerland

All three are named by the IMT in the Decreto-Lei n.º 46/2022 group, as OECD states outside the EU and EEA that signed a traffic convention. The United Kingdom also holds a bilateral agreement with Portugal, published as Aviso n.º 6/2024, de 23 de janeiro de 2024, and in force since 31 December 2023; either basis satisfies the first of the six conditions, which asks for a convention or a bilateral agreement. On that page a holder may drive in Portugal after taking up residence without exchanging, provided all six conditions hold.

This IMT is not the other IMT

IMT here is the Instituto da Mobilidade e dos Transportes, the licensing authority. IMT on a property completion statement is the Imposto Municipal sobre as Transmissões Onerosas de Imóveis, the transfer tax charged on the deed under the CIMT, and in the Autonomous Region the brackets for that tax are not the mainland ones.

What is regional about it

The IMT operates a regional branch, IMT, I.P.-RAM, which handles these procedures in Madeira and publishes the country-by-country table of regimes. The rule is national; the counter is regional. That is the same shape as health, where the entitlement is national and the service is SESARAM.

Since 21 January 2026 that counter has stopped taking the exchange application in person: IMT, IP-RAM's own notice says the service "deixou de ser realizado presencialmente" and now runs only through the IMT Services Portal (portal.imt.madeira.gov.pt).

Once the licence is settled, the roads themselves are their own subject — what driving here is actually like is a separate question from what makes it legal.

What this page will not resolve

Decreto-Lei n.º 40/2016, Decreto-Lei n.º 46/2022 and the Regulamento da Habilitação Legal para Conduzir have all been read in the Diário da República, in the official PDFs rather than in the site’s HTML viewer, which serves an empty shell. The regimes are otherwise described here as the IMT publishes them.

Iceland appears in the IMT’s EEA list and again in its OECD group, whose own heading says "OECD states that are not EU or EEA members". That is the authority’s table, not a reading of it, and this page does not resolve it. IMT, I.P.-RAM is the competent authority for these procedures in the Autonomous Region.

How long can someone drive in Portugal on a foreign licence after moving?

A licence from a country outside the conventions is not valid for driving here.

Can a US driving licence be exchanged in Portugal without a test?

The IMT lists the United States in the OECD and CPLP regime, under which an exchange is optional rather than required and a direct exchange is described for the licence categories the holder already has. Where the exchange runs under the convention regime instead, a direct exchange covers AM, A1, A2, B1, B and BE and anything beyond those requires a theory and a practical test.

Is the IMT that handles licences the same IMT as the property tax?

No. The licensing body is the Instituto da Mobilidade e dos Transportes. The property tax is the Imposto Municipal sobre as Transmissões Onerosas de Imóveis, charged on the deed and running on the Region's own brackets, see how a purchase actually runs.
